If you're handling goods in Romania, overlooking to comply with RO e-Transport regulations can lead to serious financial penalties and even confiscation of the value of your goods. The penalties are structured by the type of violation and the category of the legal entity (individual vs. company). Even more seriously, repeated offenses can trigger progressive penalties and confiscation of the value of the undeclared goods. So, whether you're a logistics operator, importer, exporter, or a warehouse manager, understanding these rules is important.
What triggers a fine?
The most common noncompliance scenarios include:
- Failing to declare local or international transports of high-risk goods in the RO e-Transport system
- Failing to declare international transports of regular goods in the RO e-Transport system
- Reporting inaccurate quantities of transported goods
- Transporting goods outside the validity period of the UIT code (5 or 15 days)
- Unloading goods during transit in Romania without a valid reason, approved storage or new shipment transformation
Penalty structure
The fines vary depending on whether the offender is a natural person or a legal entity:
- Individuals: from 10,000 to 50,000 RON
- Companies: from 20,000 to 100,000 RON
But it doesn't stop there. Repeat offenders face even stricter consequences.
Escalating penalties for repeat offense
- 2nd offense within 12 months: + 15% confiscation of the value of undeclared goods
- 3rd offense: + 50% confiscation
- 4th offense or more: + 100% confiscation
Even if the second offense occurs after 12 months, authorities can still impose a 15% confiscation penalty, and if violations continue, the third and fourth offense rules apply again.
The complementary sanction of confiscation does not apply if the noncompliance is observed after the transport ended and if the goods were recorded in the supporting documents underlying the accounting records, as well as in the users' accounting.
Other critical violations
- Modifying UIT data after transport has started
- Failure to update vehicle ID information during the UIT code's validity period
- Declaring only part of the goods in a mixed shipment
More risks
- Drivers who do not start or stop the tracking device as required, or who fail to present transport documents and UIT codes when asked by authorities, face fines between 5,000 and 10,000 RON
- Transport operators who fail to transmit live positioning data or don't equip vehicles with GPS tracking devices can be fined 10,000 to 100,000 RON
Note! For some violations, the penalties are temporarily suspended until December 31, 2025, but this grace period is not indefinite. Full enforcement is expected.
